On 16 November 2011 due to the early termination of powers of the Mazhilis of Parliament of the Republic of Kazakhstan by initiative of members of parliament, the Head of State by its Decree has set a date for early election of deputies of Mazhilis of Parliament to be elected based on party lists on 15 January 2012 and election of deputies of Mazhilis of Parliament to be elected by the Assembly of the People of Kazakhstan on 16 January 2012.
According to clause 5 of article 87 of the Election Law, nomination of candidates to deputies of the Mazhilis of Parliament to be elected based on party lists started on 16 November 2011.
In accordance with the Election Law the right to nominate candidates to deputies of the Mazhilis to be elected based on party lists belong to political parties registered in the prescribed by law manner. Communist party of Kazakhstan cannot take part in this process because its activity was suspended by the court decision. Nevertheless election commissions’ members nominated by the CPK will continue to work.
To be elected as a Mazhilis deputy a citizen of Kazakhstan must meet requirements established by clause 4 of article 51 of the Constitution as well as to have active suffrage in compliance with clauses 2 and 3 of article 33 of the Constitution.
Thus, a person, who has reached the age of 25, who is a citizen of the Republic of Kazakhstan and permanently resides in its territory for the last ten years, is eligible to be elected as a Mazhilis deputy. Those citizens, who are recognized by a court as legally incapable and who are kept in places of confinement under the court’s sentence, are not eligible to elect and to be elected.
Inclusion in the party list of persons for the election of Mazhilis deputies in the territory of the all-national election district shall be carried out by majority vote of the total number of members of the superior body of political party. Political party is not eligible to include in the party lists the persons, who are not members of this political party.
The decision of the superior body of political party and application of a citizen with consent to be included in the party lists shall be submitted to the Central Election Commission.
Political parties shall compile party lists in alphabetical order of the state language. Party lists and the extract from minutes of the superior body of political party on nomination of party list shall be submitted to the Central Election Commission by a representative of the political party.
On 16 November 2011 the Central Election Commission has adopted a resolution on setting a date for regular election of deputies of maslikhats of the Republic of Kazakhstan on 15 January 2012 and on approval of the corresponding Calendar Plan.
As Head of CEC noted at the briefing conducted after CEC session: “By taking decision on combining regular election of maslikhat deputies with early election of deputies of Mazhilis of Parliament to be elected based on party lists, we fully comply with provisions of law concerning the dates of its calling and conduct as well as with the requirements, according to which this election must not coincide with presidential election and election of the Senate deputies”.
According to the Calendar Plan approved by the CEC, information about borders of constituencies and election districts as well as about composition of precinct election commissions must be published in media not less than on 23 November 2011. And information about lists of election districts specifying their borders and locations as well as about composition of territorial and district election commission at election of deputies of maslikhats must be published not later than on 26 November 2011.
The main stages of election campaigns will be conducted in the following timeframes:
• Nomination of candidates at early election of deputies of Mazhilis of Parliament to be elected based on party lists will be held from 16 November to 5 December 2011 and registration of party lists will be held from 16 November to 15 December 2011.
• Nomination of candidates at regular election of maslikhat deputies will be held from 16 November to 14 December 2011. Nomination of candidates can be held by republican and local public associations and their structural divisions, which were registered in the manner assigned by the law as well as by citizens – as self-nominated candidates.
• Dates for the conduct of election procedures at election of Mazhilis deputies to be elected by the Assembly of the People of Kazakhstan must not coincide with the dates established for the election of Mazhilis deputies to be elected based on the party lists. The law allows it. Nomination of candidates to Mazhilis deputies to be elected by the Assembly of the People of Kazakhstan shall start on 16 December 2011.
Currently, the CEC has all necessary human and material resources and is ready to conduct elections at the appropriate organizational level ensuring the citizens and all election process stakeholders with the opportunity to implement their constitutional right freely and effectively.
In the near future the Government will solve questions of financing of the election campaigns.
Samples of election documents, necessary for organization and conduct of election campaigns, were also approved by the CEC on 16 November 2011.
Election commissions of all levels are completely staffed and able-bodied. During the year 42 new precinct election commissions have been established and their composition has been formed.
In the near future a letter on the opening of the institute of international election observers will be sent to the Ministry of Foreign Affairs. According to election legislation accreditation of observers of foreign states and international organizations will be conducted by the Central Election Commission upon presentation of the Ministry of Foreign Affairs until 10 January 2012.
In conclusion of the briefing, anticipating potential questions, K. Turgankulov noted that automated information system “Saylau” (e-voting) will not be applied at this election as well as informed the representatives of mass media about opening in the coming days of permanently working press-center of the Central Election Commission.
