On April 11, 2022, a meeting of the Central Election Commission was held for the election of a deputy of the Mazhilis, elected by the Assembly of the People of Kazakhstan instead of the retired one, scheduled for April 28, 2022
On April 11, 2022, under the chairmanship of Nurlan Abdirov, a meeting of the Central Election Commission was held, at which the following issues were considered:
1. On registration of candidates nominated by the Council of the Assembly of the People of Kazakhstan for the election of a deputy of the Mazhilis of the Parliament of the Republic of Kazakhstan instead of the retired one, scheduled for April 28, 2022;
2. On ballot paper for voting on the election of a deputy of the Mazhilis of the Parliament of the Republic of Kazakhstan elected by the Assembly of the People of Kazakhstan, instead of the retired one scheduled for April 28, 2022.
The meeting was attended by Deputy Head of the Secretariat of the Assembly of the People of Kazakhstan Leonid Prokopenko. In the videoconferencing mode - the chairman of the territorial election commission Bakhyt Bektemisova.
Deputy Chairman of the CEC Konstantin Petrov made a report on the first issue of the meeting.
In his report, he noted that in accordance with paragraph 4 of Article 87 of the Constitutional Act "On Elections in the Republic of Kazakhstan", the nomination of candidates was carried out by the Council of the Assembly from March 29 to April 7, 2022.
By the decision of the Council of the Assembly of the People of Kazakhstan, 2 candidates for deputies of the Mazhilis of the Parliament the following candidates were nominated:
1) Zakirzhan Kuziyev - born in 1969, Uighur, Chairman of the Supervisory Board of Universal LLP, lives in Almaty;
2) Vitaly Iono - born in 1964, Lithuanian, lawyer of LLP “Non-state security formation “Viking”, lives in Karaganda.
On April 6, 2022, the following documents were submitted to the Central Election Commission:
- extract from the minutes of the Council of the Assembly dated April 5, 2022 on the nomination of two candidates;
- statements of citizens about their consent to run as candidates for deputies;
- biographical data of persons nominated by the Council of the Assembly of the People of Kazakhstan;
- certificates of the state revenue authority on the submission by candidates and their spouses of declarations of assets and liabilities as of March 1, 2022.
The Central Election Commission sent requests to the authorized bodies to verify the compliance of the candidates nominated by the Council of the APK with the requirements of the Constitution and the Constitutional Law on Elections.
In accordance with paragraph 4 of Article 51 of the Constitution, a person who is a citizen of the Republic of Kazakhstan and has permanently resided on its territory for the last ten years can be a deputy of the Parliament. A deputy of the Mazhilis may be a person who has reached twenty-five years of age.
Also, a citizen must have an active suffrage in accordance with paragraphs 2 and 3 of Article 33 of the Constitution and the Constitutional Act "On Elections in the Republic of Kazakhstan":
Citizens recognized by the court as incompetent, as well as those held in places of deprivation of liberty by a court verdict, do not have the right to elect and be elected.
Cannot be a candidate for deputies of the Mazhilis of the Parliament of the Republic of Kazakhstan:
1) a person who has a criminal record that has not been canceled or removed in the manner prescribed by law;
2) a person whose guilt in committing a corruption crime and a corruption offense in the manner prescribed by law has been recognized by a court.
Based on the information provided by the Ministry of Internal Affairs, the Committee on Legal Statistics and Special Accounts of the General Prosecutor’s Office, the CEC protocol established that the candidates nominated by the Council of the APK meet the requirements set for them by the Constitution and the Constitutional Law “On Elections in the Republic of Kazakhstan”.
In this regard, members of the Central Election Commission adopted a resolution "On registration of candidates nominated by the Council of the Assembly of the People of Kazakhstan for the election of a deputy of the Mazhilis of the Parliament of the Republic of Kazakhstan instead of the retired one, scheduled for April 28, 2022."
According to the decree, Zakirzhan Kuziyev and Vitaly Iono were registered as candidates for deputies of the Mazhilis, elected by the Council of the Assembly of the People of Kazakhstan instead of the former one. Registered candidates will be placed on the ballot.
The secretary of the Central Election Commission, Mukhtar Yerman spoke on the second issue of the meeting.
In accordance with subparagraph 6) of Article 12 of the Constitutional Act “On Elections in the Republic of Kazakhstan '' the Central Election Commission shall establish its powers in the form of voting ballots for Parliamentary elections, the procedure for their production, as well as the degree of security. The degree of ballot security is established for each election campaign.
All registered candidates are included in the ballot indicating the last name, first name, patronymic in the alphabetical order of the state language and the line “Against all”. Ballot papers are printed in the state and Russian languages.
The form of the ballot paper for voting on the elections of deputies of the Mazhilis of the Parliament of the Republic of Kazakhstan, elected by the Assembly of the People of Kazakhstan, was approved by the Resolution of the Central Election Commission of the Republic of Kazakhstan dated August 23, 2018 No. 11/192.
In accordance with Article 37 of the Constitutional Act on Elections, ballot papers are produced with a reserve of 1 percent of the total number of voters. The list of voters for the election of a deputy to the Mazhilis of the Parliament, elected by the Assembly of the People of Kazakhstan, includes 527 members of the Assembly.
Based on the norms of the Constitutional Act on Elections, a resolution was adopted "On the ballot paper for voting on the election of a deputy of the Mazhilis of the Parliament of the Republic of Kazakhstan elected by the Assembly of the People of Kazakhstan instead of the retired one, scheduled for April 28, 2022."
The Central Election Commission decided to approve the text of the ballot for voting and establish the degree of its security.
According to the resolution, the number of ballots to be produced, including a reserve of one percent of the total number of members of the Assembly of the People of Kazakhstan, is 532 units.
The Office of the Central Election Commission will ensure the delivery of ballot papers to the election commission of Nur-Sultan no later than April 26, 2022.
Deputy Head of the APK Secretariat Leonid Prokopenko informed the CEC members that by the order of the Head of State on April 28 this year. The thirtieth session of the Assembly of the People of Kazakhstan has been appointed, at which elections will be held for a deputy of the Majilis elected by the Assembly of the People of Kazakhstan instead of the retired one.
Chairman of the TEC of Nur-Sultan Bakhyt Bektemisova reported that the electoral committee of the capital is taking all necessary measures to prepare and hold the upcoming elections.
At the end of the meeting, Chairman of the Central Election Commission Nurlan Abdirov noted that the election of a deputy of the Mazhilis elected by the Assembly of the People of Kazakhstan instead of the retired one should be held in strict accordance with the electoral legislation and in compliance with all electoral procedures.
It should be noted that the registration of candidates ends at 18:00 on April 12. From the moment the deadline for registration of candidates expires, the stage of campaigning begins and ends at zero o'clock local time on the day preceding the election day - April 27.
