The meeting of the Central Election Commission on the refusal to register
candidates for the President of the Republic of Kazakhstan B. Zhanabayev,

On October 21, 2022, a meeting of the Central Election Commission of the Republic of Kazakhstan was held under the chairmanship of Nurlan Abdirov. The meeting was attended by representatives of state bodies, the media, as well as members of territorial election commissions in the videoconferencing mode.
Sabila Mustafina, a member of the Central Election Commission, made a report on the first item on the agenda. She said that, in accordance with the requirements of the Constitutional Act “On Elections in the Republic of Kazakhstan,” Bakyt Zhanabayev for registration as a presidential candidate submitted a certificate of submission of declarations of assets and liabilities by the candidate and his spouse and a medical report on the state of health.
According to the protocols of the territorial election commissions, 58,889 signatures were collected in support of the candidate. According to the results of the verification, 4,054 signatures were recognised as reliable. This is less than one percent of the total number of voters.
Thus, the requirement of paragraph 2 of Article 56 of the Constitutional Act on Elections on the required number of signatures of voters in support of the candidate has not been fulfilled.
Reference: In accordance with paragraph 2 of Article 56 of the Constitutional Act of the Republic of Kazakhstan “On Elections in the Republic of Kazakhstan,” a candidate shall be supported by at least one percent of the total number of voters equally representing at least two thirds of regions, cities of republican significance and the capital of the Republic (118,273 signatures).
By a resolution of the CEC of the Republic of Kazakhstan, Bakyt Zhanabayev was denied registration as a candidate for the President of the Republic of Kazakhstan at the early elections of the President of the Republic of Kazakhstan, scheduled for November 20, 2022.
Member of the Central Election Commission Shavkhat Utemissov made a report on the second item on the agenda. He said that Nurzhan Altayev was nominated by the “Muqalmas” Republican Public Association on October 6, 2022.
Due to the fact that by the decision of the court of the Baikonyr district of Astana dated October 11, 2022, the protocol of the “Muqalmas” Republican Public Association on the nomination of N. Altayev as a candidate for President of the Republic of Kazakhstan was suspended, on October 12 this year the CEC suspended the procedure for establishing compliance with the requirements of the Constitution and the Constitutional Act “On Elections in the Republic of Kazakhstan”.
On October 17, 2022, the court, by its decision, declared the above protocol invalid.
Thus, currently, the CEC does not have a valid document on the nomination of N. Altayev as a candidate for the President of the Republic of Kazakhstan. Based on this, the CEC found that N. Altayev does not meet the requirements established by Article 54 of the Constitutional Act “On Elections in the Republic of Kazakhstan” and refused to register him as a candidate for the President of the Republic of Kazakhstan.
Anastassiya Schegortsova, a member of the Central Election Commission, made a report on the third item on the agenda. She said that Zhumatai Aliyev, in accordance with the requirements of the Constitutional Act “On Elections in the Republic of Kazakhstan,” submitted for registration as a presidential candidate a certificate of the candidate’s submission of a declaration of assets and liabilities and a medical report on the state of health. At the same time, the submitted medical report does not comply with the established form approved by the Joint Regulatory Resolution of the CEC of the Republic of Kazakhstan dated April 13, 2019 No. 12/236 and the order of the Ministry of Health of the Republic of Kazakhstan dated April 13, 2019 No. KR DSM-32.
According to the protocols of the territorial election commissions, 187,723 signatures were collected in support of the candidate. According to the results of the verification, 36,776 signatures were recognised as reliable. This is less than one percent of the total number of voters.
Thus, the requirement of paragraph 2 of Article 56 of the Constitutional Act on Elections on the required number of signatures of voters in support of the candidate has not been fulfilled.
